These Terms of Use apply to the website located at www.acumenconsultants.io and any affiliated digital properties, including Acumen Consultants, Inc.’s mobile applications, and online platforms (collectively, the “Platform”); the consulting services, client portals, research tools, and other offerings accessible through or enabled by the Platform (together with the Platform, the “Services”); any reports, publications, templates, or other materials provided by Acumen (“Deliverables”); and any events, webinars, or professional engagements hosted by Acumen or conducted in collaboration with its partners (“Engagements”).

Content

All material accessible through the website at www.acumenconsultants.io, including but not limited to text, images, graphics, photographs, reports, research, guidelines, data, articles, templates, documents, studies, position papers, and other works of authorship; samples, demonstrations, and interactive features; technology, designs, methods, concepts, know-how, and techniques; and software, source code, architecture, user interfaces, visual layout, structure, coordination, and overall look and feel (collectively, the “Content”), is the proprietary information of Acumen Consultants, Inc. (“Acumen”) or its licensors. Acumen and its licensors retain all right, title, and interest in and to the Content, whether existing now or developed in the future.

The Site and its Content are protected by applicable intellectual property laws, including copyright, trademark, trade dress, and patent laws, as well as other United States and international legal protections. Except as expressly permitted under these Terms of Use, no portion of the Site or its Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any form or by any means, including mirroring, without Acumen’s prior written consent.

Subject to your compliance with these Terms of Use, Acumen Consultants, Inc. (“Acumen”) grants you a limited, nonexclusive, nontransferable, non-sub-licensable, and revocable license to access and use the website at www.acumenconsultants.io and its Content solely for informational and noncommercial purposes. Acumen Consultants, Inc. (“Acumen”) reserves the right to restrict or prohibit any such activity. Unauthorized access to any part of the Site, or to any systems, networks, servers, or services connected to the Site, is strictly prohibited. This includes, but is not limited to, attempts to gain access through hacking, password mining, or any other illegitimate means.

You may not probe, scan, or test the vulnerability of the Site or any network connected to it, nor breach any security or authentication measures. You may not reverse-engineer, trace, or attempt to trace any information about other users or visitors to the Site, or any Acumen client account not owned by you, for the purpose of uncovering personal identification or other protected information. You further agree not to interfere with or disrupt the proper functioning of the Site, any transaction conducted on the Site, or any other user’s experience.

Impersonation of any individual or entity, or misrepresentation of your affiliation with any person or organization, is strictly prohibited. User Account

This Site may require users to submit registration details or other identifying information. As a condition of use, you agree that all information you provide will be accurate, current, and complete. You are responsible for maintaining the confidentiality and security of your account credentials and must promptly notify Acumen Consultants, Inc. (“Acumen”) of any unauthorized access or suspected breach. Passwords, if applicable, are issued for individual use only and must not be shared. You are solely accountable for the integrity of your password and any activity conducted under your account. Acumen reserves the right to monitor password usage, require updates, and, at its discretion, suspend or terminate access to the Site or its resources at any time and for any reason.

International Users

This Site is operated by Acumen Consultants, Inc. (“Acumen”) from its offices within the United States. Acumen does not represent or warrant that the Site or its Content is appropriate or available for use in jurisdictions outside the United States. Accessing the Site from locations where its Content may be restricted or unlawful is strictly prohibited. If you choose to access the Site from outside the United States, you do so voluntarily and are solely responsible for complying with any applicable local laws.

Violation of Terms of Use

Acumen Consultants, Inc. (“Acumen”) reserves the right to disclose any information it possesses about you, including your identity, if it determines such disclosure is necessary in connection with an investigation or complaint related to your use of the Site, or to identify, contact, or pursue legal action against any party whose conduct may interfere with or harm Acumen’s rights, property, or the interests of other users. Acumen may also disclose information as required to comply with applicable laws, regulations, legal processes, or governmental requests, and may share data with third parties for fraud prevention or security purposes.

You acknowledge that Acumen may preserve communications or transmissions between you and the Site, and may disclose such records if required by law or if Acumen reasonably determines that such disclosure is necessary to comply with legal obligations, enforce these Terms of Use, respond to claims of rights violations, or protect the safety, property, or interests of Acumen, its personnel, users, or the public. Acumen may, at its sole discretion and without prior notice, suspend or terminate your access to the Site if it determines that you have violated these Terms of Use or any related policies or agreements. You further agree that any such violation constitutes an unlawful and unfair business practice that may cause irreparable harm to Acumen, and that Acumen may seek injunctive or equitable relief in addition to any other remedies available under law.

Termination of access may also occur without notice for reasons including, but not limited to, requests by law enforcement or regulatory authorities, account deletion requests initiated by you, discontinuation or substantial modification of the Site or its services, or unforeseen technical issues. If Acumen initiates legal proceedings against you due to a breach of these Terms of Use, it will be entitled to recover all reasonable legal fees and associated costs, in addition to any other relief granted. Acumen shall not be liable to you or any third party for termination of access resulting from any violation of these Terms.

Acumen Consultants, Inc. (“Acumen”) does not guarantee that the Site or any Content, service, or feature will be error-free or uninterrupted, that defects will be corrected, or that your use of the Site will yield specific results. The Site and all Content are provided on an “as-is” and “as-available” basis. All information presented on the Site is subject to change without notice. Acumen cannot ensure that any files or data you download from the Site will be free from viruses, contamination, or other destructive elements. Limitation of Liability

Indemnity

Governing Law & Jurisdiction

You agree that all matters relating to these Terms of Use and your access to or use of the Site will be governed by the laws of the United States and the State of Georgia, without regard to conflict-of-law principles. You agree that any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the jurisdiction and venue of those courts for any such matter.

Void Where Prohibited

Although this Site is accessible globally, certain features, services, or content may not be available or appropriate for use in all jurisdictions. Acumen Consultants, Inc. (“Acumen”) reserves the right to limit access to any portion of the Site, or to restrict the availability of specific features, products, or services, at its sole discretion and without notice, based on geographic location or other criteria. Any offer made through the Site is void where prohibited. If you access the Site from outside the United States, you do so voluntarily and are solely responsible for complying with all applicable local laws and regulations.

Miscellaneous

If any provision of these Terms of Use is found by a court or other authority with proper jurisdiction to be unlawful, void, or unenforceable, that provision will be modified or removed only to the extent necessary to render it enforceable, and replaced with a valid term that most closely reflects the original intent. (“Acumen”) regarding your use of the Site. References to “Acumen,” “we,” “us,” and “our” refer to Acumen Consultants, Inc.
